Brand & Collaboration Principles

The trademarks, service marks, artistic works, logos, designs, and brand identifiers associated with ORNELLA GALLO®, Ornella Gallo Art, and Ornella Gallo Design (collectively, the “ORNELLA GALLO DI FORTUNA Marks” or OR ) are valuable intellectual property assets owned exclusively by Ornella Gallo Di Fortuna and/or her affiliated entities.

Proper use of the ORNELLA GALLO DI FORTUNA Marks is essential to maintain their integrity, artistic value, and legal protection.

All authorized collaborators, suppliers, licensees, partners, and exhibitors (“Authorized Users”) must comply with these guidelines as a condition of use, in addition to any separate written agreement.

Failure to comply may result in immediate withdrawal of permission to use the ORNELLA GALLO DI FORTUNA Marks and may carry legal consequences.

These Terms and Conditions of Sale govern all bespoke commissions and creative collaborations between DI FORTUNA LIMITED (Company No. 08359939), trading as Ornella Gallo Art & Design (“the Studio”), and the client (“Client”). By commissioning work from the Studio, the Client agrees to these terms.

Artistic Authorship

All artworks, concepts, and creative direction developed under ORNELLA GALLO DI FORTUNA® remain the exclusive intellectual property of Ornella Gallo Di Fortuna unless otherwise agreed in writing.

Collaboration does not transfer authorship.

Where materials or fabrication partners are involved, artistic creation and conceptual leadership remain solely attributed to ORNELLA GALLO DI FORTUNA®

Brand Representation

ORNELLA GALLO DI FORTUNA ®, Ornella Gallo Art, and Ornella Gallo Art & Design are protected brand identifiers.

Use of the name, logo, or artwork imagery requires prior written approval.

The brand name may not be modified, translated, shortened, or used as a generic descriptor.

Original artwork by ORNELLA GALLO DI FORTUNA ®

Presentation Standards

All exhibitions, installations, commercial integrations, or brand activations involving ORNELLA GALLO DI FORTUNA ® must reflect premium presentation standards aligned with international art and luxury environments.

Where engaged in a Creative Direction capacity, final artistic approval remains with ORNELLA GALLO DI FORTUNA ® to ensure aesthetic integrity and brand alignment.

Marketing  Usage & Communication

Collaborators may reference the partnership within the agreed scope of the project.  Any use of:

  • Artwork imagery

  • Studio photography

  • Brand name

  • Logo

requires prior approval before publication.

Usage must clearly distinguish between:

  • Artistic authorship

  • Material supply

  • Fabrication

  • Sponsorship

Past collaborations do not grant automatic rights for future marketing usage.

Use as Brand Identifier (Not Generic Term)

The ORNELLA GALLO Marks must always be used as brand identifiers and not as generic product descriptions.

Correct examples:

  • “A commissioned artwork by ORNELLA GALLO®”

  • “Featuring an original Ornella Gallo Design installation”

Incorrect examples:

  • “An Ornella”

  • “A Gallo mosaic”

The brand name must not be modified, shortened, pluralized, or translated.

 No Implied Endorsement

Project-based collaborations do not constitute:

  • Permanent partnership

  • Brand endorsement beyond agreed scope

  • Equity or ownership in the ORNELLA GALLO DI FORTUNA® brand

All rights remain exclusively with Ornella Gallo Di Fortuna.

Infringement & Misuse

Authorized Users agree to notify Ornella Gallo Di Fortuna immediately if they become aware of:

  • Unauthorised use

  • Imitation or copying

  • Misrepresentation

  • Dilution of the ORNELLA GALLO DI FORTUNA brand

Brand Integrity

ORNELLA GALLO DI FORTUNA® selectively collaborates with partners whose values align with its artistic vision and positioning.

Any context that compromises brand integrity may result in withdrawal of usage permission.

Quality & Context

ORNELLA GALLO DI FORTUNA® selectively collaborates with brands, institutions, and clients whose values align with its artistic vision and positioning.

Any context that may dilute, misrepresent, or compromise the brand’s integrity may result in withdrawal of usage permission.

 Duration of Use

Marketing and promotional usage related to a specific collaboration is limited to the duration and scope agreed in writing.

Extended usage requires renewed approval.

Mutual Brand Protection

All collaborating parties agree to uphold standards that preserve the reputation, positioning, and artistic value associated with ORNELLA GALLO DI FORTUNA®

Updates

This framework may be updated periodically to reflect evolving collaborations and brand development.

Differentiation

Authorized Users must clearly differentiate:

  • ORNELLA GALLO artworks from supplier materials

  • Artistic direction from fabrication

  • Creative authorship from material sourcing

No supplier may imply artistic authorship of works created by Ornella Gallo.

Creative Director Authority Clause

Where Ornella Gallo Di Fortuna is engaged as Creative Director, the following applies:

  1. ORNELLA GALLO DI FORTUNA® retains final approval over all artistic and visual aspects of the project, including but not limited to:

    • Spatial layout and integration

    • Artwork placement

    • Lighting affecting artwork

    • Material application impacting artistic integrity

    • Visual communication associated with the installation

  2. Fabrication, production, and technical teams shall execute in alignment with the approved artistic direction.

  3. Any deviation that materially alters the aesthetic outcome requires prior written approval from ORNELLA GALLO DI FORTUNA®

  4. If execution conditions compromise artistic standards or brand positioning, ORNELLA GALLO DI FORTUNA® reserves the right to withdraw name association from the final installation.

Compliance With Laws

All uses must comply with:

  • Applicable intellectual property laws

  • Advertising regulations

  • Country-of-origin and attribution laws

  • Fair competition standards
